$3 Million Jury Request Rebuffed

In March of 2013, Dave Faulkner and Mike Orsi obtained a not guilty verdict for a local gastroenterologist and his group. The patient, who experienced a colon perforation and colectomy following a follow-up colonoscopy, claimed that he had not been appropriately advised about the risks. He argued that he was never informed that, as an ulcerative colitis patient, a repeat colonoscopy carried a higher risk of perforation and that if a perforation occurred colectomy (colon removal) would almost always be necessary. Multiple surgeries followed and the 42 year old patient continued to experience significant pain and incontinence problems. Plaintiff asked for a verdict of over $3 million in damages.
